Terms of Service

These terms govern your use of the ScapeRevive app and related services operated by ETNA. They are intended for in-app links and store listings (Terms of Use).
1. Acceptance of terms
By downloading, installing, or using the ScapeRevive application ("App") or any related services ("Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the App or Services. The App is distributed as ScapeRevive and is built from the Lakeview Interlock codebase (repository code_lakeview_interlock); our Firebase / Google Cloud backend project identifier is etna.
Before you create an account or use the App, you may be shown links to these Terms and to our Privacy Policy. Your continued use of the App constitutes acceptance of these Terms and our Privacy Policy.
2. Description of the service
The App provides AI-powered visualization tools for driveways, patios, and outdoor surfaces (e.g. paver styles, lighting, and seasonal looks). Features include:
- Image-to-image generation (e.g. applying paver styles or lighting to your photos).
- Pro and advanced editing options, upscaling, and related features.
- Optional video generation and other tools as described in the App.
- Handy AI assistant: an in-app AI-powered chat feature that provides personalized design suggestions, material guidance, project support, and answers to questions about hardscaping and outdoor surfaces. Handy AI responses are generated by Google's Gemini API and are informational in nature.
Access to many features is based on a credit system and/or subscription (e.g. Pro Monthly or Pro Yearly). Credits may be granted for free (e.g. welcome credits) or purchased (e.g. credit packs). Subscription terms and credit costs for each action are shown in the App.
3. Account and eligibility
- You must provide accurate and complete information when creating or updating your account. You are responsible for keeping your login details secure.
- You may use the App as a guest (anonymous account) or create a registered account (e.g. with email, Google, or Apple). Linking a guest account to a permanent account may preserve your credits and history as described in the App.
- You must be at least 13 years of age (or the minimum age in your jurisdiction) to use the App. If you are under 18, you should have a parent or guardian's consent.
- We may suspend or terminate your account if you breach these Terms or misuse the Services.
4. Acceptable use
You agree to use the App and Services only for lawful purposes and in line with these Terms. You must not:
- Use the App in any way that violates applicable laws or regulations.
- Infringe any third-party rights (e.g. intellectual property, privacy, or publicity rights).
- Upload or generate content that is illegal, harmful, offensive, or that you do not have the right to use.
- Attempt to reverse-engineer, bypass, or abuse the credit system, authentication, or security measures.
- Resell, sublicense, or commercially exploit the App or Services in a way not permitted by us.
- Use the App to send spam, malware, or to harm other users or our systems.
- Use Handy AI to attempt to circumvent safety measures, generate harmful or misleading content, submit prompt injection attacks, or abuse the feature in a way that degrades service quality for others.
- Use Handy AI to seek professional advice (legal, medical, structural engineering, or otherwise) as a substitute for consulting a qualified professional. Handy AI is a design and project support tool only.
We may remove content, suspend access, or terminate accounts that we reasonably believe violate these rules.
5. Intellectual property
- The App, its design, code, branding, and content (except user-generated content) are owned by us or our licensors. You do not acquire any ownership by using the App.
- You retain ownership of content you upload (e.g. photos). By uploading content, you grant us a license to use, store, and process it as needed to provide the Services (e.g. to generate images or videos). You represent that you have the right to grant this license.
- Generated outputs (e.g. images or videos created by the App) are made available to you for your personal or business use in line with these Terms. We do not claim ownership of your generated outputs, subject to our right to operate and improve the Services.
6. Credits, subscriptions, and payments
6.1 Credit system
The App uses two types of credits:
- Subscription credits: Granted when you subscribe to a Pro plan (e.g. Pro Starter, Pro Builder). These credits are allocated at the start of each billing cycle and reset upon renewal — unused subscription credits from the previous cycle do not roll over.
- Purchased credits (credit packs): Acquired through one-time, consumable purchases (e.g. Homeowner Starter, Project Pack, High Volume). These credits are added to your account balance and persist across subscription renewals. They are consumed only when you use them and are not affected by subscription billing cycles.
When you perform a credit-consuming action, subscription credits are used first. Purchased credits are used only after subscription credits are exhausted.
6.2 Subscriptions
- Subscriptions (e.g. Pro Starter, Pro Builder) provide a monthly credit quota and access to Pro features for the duration of the subscription.
- Subscription credits do not roll over — at the start of each new billing cycle, subscription credits are reset to the plan's monthly quota.
- If you upgrade or downgrade your plan, your subscription credits are reset to the new plan's quota. Purchased credits are not affected.
- If you cancel your subscription, you retain access and any remaining credits until the end of the current billing period. No further renewals will occur.
- If your subscription expires, your subscription status is updated accordingly. Any remaining credits (subscription or purchased) remain available but Pro-exclusive features may become inaccessible.
6.3 One-time credit packs
- Credit packs (consumable purchases) add credits to your purchased credits balance immediately upon successful payment.
- Purchased credits do not expire and are not affected by subscription renewals, upgrades, downgrades, or cancellations.
6.4 Payments and refunds
- Subscriptions and one-time purchases are processed through the Apple App Store and/or Google Play, or in permitted regions via web (e.g. Stripe). Your contract for payment is with the applicable store or payment provider; their terms and refund policies apply.
- Refunds for in-app purchases are handled by Apple or Google in accordance with their policies. For web or other payments, our refund policy (if any) will be stated at the point of purchase or in the App.
- We do not guarantee refunds for unused credits or partial subscription periods except where required by law or as stated in the App or by the store.
- Credits obtained through a refunded purchase may be deducted from your account.
6.5 Account requirement
- You must have a registered account (not a guest/anonymous account) to make purchases. Guest users will be prompted to sign up before accessing the payment flow.
7. Credit amounts and pricing changes
We may change the number of credits required for each type of action (e.g. image generation, pro edit, upscale, video) at any time. Such changes may be made for operational reasons or to reflect changes in third-party costs (for example, increases in AI provider pricing). The current credit amounts for each action are shown in the App. We will use reasonable means to inform you of significant changes (for example, through the App or by email). Continued use of the service after a change constitutes acceptance of the updated terms.
We may also change subscription plan credit quotas, credit pack amounts, or pricing. Price changes will apply to new purchases or renewals as of the effective date; we will notify you in advance where required by law or by the store. Changes to subscription credit quotas take effect at the next renewal.
8. Disclaimers
- The App and Services are provided "as is" and "as available." We do not warrant that the App will be uninterrupted, error-free, or free of harmful components.
- AI-generated outputs are not guaranteed to be accurate, complete, or suitable for any particular use. You use them at your own risk. We are not liable for decisions you make based on generated content.
- To the fullest extent permitted by law, we disclaim all warranties (express or implied), including merchantability and fitness for a particular purpose.
9. Limitation of liability
- To the maximum extent permitted by applicable law, we (and our affiliates, directors, employees, and agents) shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or goodwill, arising out of or in connection with your use of the App or Services.
- Our total liability for any claims arising from or related to these Terms or the App shall not exceed the amount you paid us in the 12 months preceding the claim (or, if no payment, fifty US dollars (USD 50)).
- Some jurisdictions do not allow the exclusion or limitation of certain damages; in those jurisdictions, our liability will be limited to the fullest extent permitted by law.
10. Termination
- You may stop using the App at any time. You may also delete your account from within the App (Account → Danger Zone → Delete Account). Account deletion is subject to our Privacy Policy.
- We may suspend or terminate your access to the App or Services if you breach these Terms, for operational or legal reasons, or otherwise at our discretion. Where reasonable, we will give you notice.
- Upon termination, your right to use the App and Services ceases. Provisions that by their nature should survive (e.g. disclaimers, limitation of liability, dispute resolution) will remain in effect.
11. Changes to the terms
We may update these Terms from time to time. We will post the updated Terms in the App and/or on our website and will update the "Last updated" date. For material changes, we will use reasonable means to inform you (e.g. in-app notice or email). Continued use of the App after the effective date of the new Terms constitutes acceptance of the updated Terms. If you do not agree, you must stop using the App and may delete your account.
12. Governing law and disputes
These Terms are governed by the laws of Ontario, Canada, without regard to conflict-of-law principles. Any dispute arising out of or relating to these Terms or the App shall be resolved in the courts of that jurisdiction, except where prohibited by law.
If you are in the European Union or United Kingdom, you may also have the right to bring a claim before a competent supervisory authority or in your country of residence.
13. General
- Entire agreement: These Terms (together with the Privacy Policy and any in-app terms or store terms that apply) constitute the entire agreement between you and us regarding the App and Services.
- Severability: If any part of these Terms is held invalid or unenforceable, the remaining parts will remain in effect.
- No waiver: Our failure to enforce any right or provision does not waive that right or provision.
- Assignment: We may assign our rights and obligations under these Terms; you may not assign without our prior written consent.
15. Handy AI assistant
15.1 Nature of Handy AI
Handy AI is an in-app conversational assistant powered by Google's Gemini API. It provides design suggestions, material guidance, and general project support for hardscaping and outdoor surface projects. Handy AI responses are generated by a large language model and are informational only.
15.2 No professional advice
Handy AI is not a substitute for advice from a qualified professional (e.g. structural engineer, licensed contractor, architect, lawyer, or medical professional). Any suggestions provided by Handy AI should be treated as starting points for your own research and judgment. We are not liable for decisions made based solely on Handy AI output.
15.3 Accuracy and limitations
AI-generated responses may be inaccurate, incomplete, or outdated. We do not guarantee that any suggestion, estimate, material recommendation, or design advice provided by Handy AI is correct, suitable for your specific conditions, or compliant with local building codes or regulations. You use Handy AI responses at your own risk.
15.4 Third-party processing
When you use Handy AI, your messages and relevant session context are transmitted to Google's Gemini API for response generation. By using Handy AI, you acknowledge that your messages will be processed by Google in accordance with Google's terms of service and privacy policy. We do not control Google's processing of that data beyond our API configuration. For more information, see the Handy AI section of our Privacy Policy.
15.5 Prohibited use of Handy AI
In addition to the general acceptable use rules in section 4, you must not use Handy AI to:
- Attempt to override, bypass, or "jailbreak" the AI model's safety or content filters.
- Generate content that is false, defamatory, discriminatory, or intended to harm any individual or group.
- Systematically query the assistant in a way that constitutes an automated attack or that disrupts the service.
- Collect or harvest AI outputs at scale for the purpose of training or evaluating competing AI systems.
15.6 Disclaimer for Handy AI
To the fullest extent permitted by law, we disclaim all warranties regarding Handy AI outputs, including accuracy, fitness for a particular purpose, and non-infringement. Our standard limitation of liability (section 9) applies to all claims arising from your use of Handy AI.
